Child Car Seat Injury Lawsuit Update

In 2015, Graco agreed to pay $10 million to settle a class action lawsuit. Consumers alleged Graco child car seats were manufactured with a defective belt, making it difficult to unbuckle a child in the event of an emergency. In fact, an infant died in a car fire after the buckle got stuck and the mother was unable to remove her infant child from the car seat. A wrongful death lawsuit was filed against the manufacturer, which was resolved in a confidential settlement. In addition, a year after this preventable accident, the National Highway Traffic Safety Administration (NHTSA) opened an investigation into that particular car seat and 17 models designed and manufactured by Graco. The investigation revealed numerous instances of the harness buckle being difficult or impossible to unlatch. Graco knew of this problem, having received over 6,000 complaints from parents all over the U.S. Despite the National Highway Traffic Safety Administration (NHTSA) demanding Graco voluntarily recall the defective product, Graco refused. Putting our children at risk of severe personal injury. Graco argued that it was the fault of the parents by leaving food and allowing fluids to get into the buckles. Several months of requests from NHTSA finally resulted in a Graco recall of the car seats with defective belts.

In 2014, a lawsuit was filed against car seat manufacturer, Evenflo. A young child was seriously and permanently injured while restrained in the manufacturer’s booster car seat. It is alleged that Evenflo ignored the safety recommendations of the National Highway Traffic Safety Administration (NHTSA) and the American Academy of Pediatrics, by inviting smaller children to be placed in a belt position booster seat when those children would be safer being in a five point harness safety seat. Furthermore, in 2007 a Montana jury ordered Evenflo, a major child car seat manufacturer, to pay a family nearly $6.7 million in personal injury lawsuit damages. Their infant son suffered his wrongful death as a result of a defective child seat belt hook system and lack of energy-absorbing padding.
